Temporary Agricultural Workers (H-2A Visas)

The H-2A Visa program establishes a means for agricultural employers who anticipate a shortage of domestic workers to bring nonimmigrant foreign workers to the United States to perform agricultural labor or services of a temporary or seasonal nature. An Employment will be considered of a seasonal nature when it is tied to a certain time of year by an event or pattern, usually in relation to the production and/or harvesting of a crop. An Employment will be considered of a temporary nature when the employer’s need to fill the position with a temporary worker is for a limited time period of less than one year.

Before the United States can approve an employer's petition for such workers, the employer must first acquire a Labor Certification by proving that there are not sufficient workers who are able, willing, qualified, and available, and that the employment of foreign workers will not adversely affect the wages and working conditions of similarly employed United States workers. The statute and Departmental regulations provide for numerous worker protections and employer requirements with respect to wages and working conditions.
